Ford Cracked Tailgate Litigation

On June 15, 2011, MURRAY FRANK LLP filed a class action complaint, in the United States District Court for the Northern District of California, on behalf of a proposed nationwide class of consumers of certain Ford SUVs that have experienced damage, in the form of a large crack, to the tailgate of their vehicles. An image of the sample crack is set forth in the picture below:

The affected vehicles include model 2002 through model 2005 Ford Explorers and Mercury Mountaineers, and model 2003 through model 2005 Lincoln Aviators.

The complaint alleges that although Ford knew about the cracked tailgate issue in early-2002, Ford continued to sell the affected vehicles and systematically refused to repair or replace the damaged tailgates both inside and outside of the warranty period.
